Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Blargo, LLC, doing business as Passenger Seat (“Passenger Seat,” “we,” “us,” or “our”), governing your use of the Passenger Seat app and related services (the “Service”). By installing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service and beta status

Passenger Seat is a travel companion app that uses your approximate location to tell you about interesting places as you drive. The Service is currently offered as a pre-release beta. That means it may change, may be unavailable or interrupted at times, and may contain errors. We may add, modify, or remove features at any time.

Eligibility and your account

You must be at least 13 years old, and old enough to hold a valid driver's license in your jurisdiction if you intend to use the Service while driving, to use Passenger Seat. You sign in using Sign in with Apple. You are responsible for activity that occurs under your account and for keeping your device secure.

Acceptable use

You agree not to:

• use the Service in any way that is unlawful, unsafe, or that endangers yourself or others;
• attempt to access, disrupt, or interfere with the Service, our systems, or other users' use of the Service;
• reverse engineer, scrape, or attempt to extract source code or data except as permitted by law;
• resell, redistribute, or commercially exploit the Service or its content without our permission.

Content and accuracy

Passenger Seat generates stories and narration automatically using AI and third-party sources. While we work hard to make the content interesting and correct, it may be incomplete, outdated, or inaccurate. The content is provided for entertainment and general information only. Do not rely on it for navigation, safety, legal, or other important decisions.

Purchases and subscriptions

Some features may require a purchase or subscription. Payments are processed by Apple through your App Store account, and may be managed by our provider RevenueCat. Prices, billing periods, and what is included may change. Subscriptions renew automatically unless cancelled through your App Store account before the renewal date. Except where required by law or Apple's policies, purchases are non-refundable.

Intellectual property

The Service, including its software, design, branding, and generated content made available to you, is owned by Passenger Seat or its licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own, non-commercial use, subject to these Terms.

Third-party services

The Service relies on third-party providers, including Apple, cloud hosting and infrastructure providers, AI providers, mapping and reference sources, analytics providers, and email providers. Your use of the Service may also be subject to their terms. We are not responsible for third-party services we do not control.

Termination

You may stop using the Service at any time and delete your account from within the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error free, or that content will be accurate.

Limitation of liability

To the fullest extent permitted by law, Passenger Seat will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the Service, including any harm related to driving or reliance on generated content. Nothing in these Terms limits liability that cannot be limited under applicable law.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the date at the top. Significant changes may be communicated in the app or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.
